Withdrawal and returns

1. Scope

A consumer buying an existing work at a distance generally has 14 days after physical receipt to withdraw without giving a reason. An enquiry without a contract needs no return. Atelier purchases do not automatically carry the same no-reason withdrawal right.

2. Notify withdrawal

Send an unequivocal notice to [email protected] or by post to the registered address below before the deadline. The optional form below may be used. The seller acknowledges receipt and provides shipping instructions.

3. Return the work

Send the work within 14 days of notifying withdrawal to the seller at the registered address below, unless another address is mutually agreed. Use protective packing. Direct return costs are yours only if disclosed before the contract; otherwise the seller bears them. For works not normally returnable by post, the cost or a reasonable estimate is disclosed before purchase. Original packing is recommended, not an absolute condition.

4. Refund

Amounts due, including initial standard delivery, are refunded within 14 days of notice using the same payment method unless otherwise expressly agreed without additional cost. The seller may withhold until receiving the goods or evidence of dispatch, whichever occurs first, where permitted by law. The extra cost of a premium delivery chosen instead of standard delivery is not reimbursed.

5. Handling

You may inspect the work as needed to establish its nature, characteristics and functioning. Excessive handling may cause an actual loss in value recoverable under the law, without arbitrary fees or automatic loss of withdrawal rights.

6. Personalised works

The legal exception concerns works made to customer specifications or clearly personalised. An existing original, including a unique painting, is not excluded merely because it is unique. Applicable exceptions are explained before a personalised commission and do not remove conformity rights.

7. Conformity

Legal conformity protection is separate from withdrawal. For new goods the seller is responsible under applicable law for non-conformity becoming apparent within two years of delivery. Remedies may include repair or replacement where possible, a price reduction or termination subject to legal conditions. Uniqueness does not remove these rights. Damage caused by improper use after delivery is not covered.
